Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the NEXT LEVEL HOOPS mobile application (the “App”) operated by NEXT LEVEL HOOPS (“us”, “we”, or “our”).

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

2. Use of the App

The App is intended for personal, non-commercial use. You agree not to use the App for any illegal or unauthorized purposes. You must comply with all local laws regarding online conduct and acceptable content.

3. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of NEXT LEVEL HOOPS and its licensors. You may not reproduce, distribute, or create derivative works based on the App without our prior written consent.

4. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

5. Limitation of Liability

In no event shall NEXT LEVEL HOOPS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• (i) your use or inability to use the App;
• (ii) any unauthorized access to or use of our servers and/or any personal information stored therein;
• (iii) any interruption or cessation of transmission to or from the App;
• (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party;
• (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

These limitations apply whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damages.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

7. Changes

We reserve the right to modify or replace these Terms at any time, at our sole discretion. If a revision is material, we will provide at least 30 days’ notice prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion.
